Introduction

These Terms of Service (“Terms”) govern your use of FortyPharma, including its website, mobile app, and any related services. By accessing or using FortyPharma, you agree to comply with these Terms. If you do not agree, do not use the platform.

Eligibility and Account Responsibilities

• Users must be at least 18 years old or have parental/guardian consent to use FortyPharma.
• You are responsible for maintaining the confidentiality of your account credentials.
• All information provided must be accurate and up-to-date. FortyPharma may suspend accounts with false or misleading information.

Permitted Use

You may use FortyPharma only for lawful educational and business purposes. Prohibited actions include:

• Unauthorized access to other users’ accounts or data.
• Uploading, distributing, or sharing content that violates intellectual property, privacy, or local/international laws.
• Interfering with the platform’s security, performance, or network operations.
• Commercial resale of content or services from FortyPharma without prior authorization.

Content Ownership

All platform content, including software, branding, and course materials, is owned by FortyHives or its licensors. Tutors and institutions retain ownership of their original materials but grant FortyPharma a non-exclusive license to distribute and display their content on the platform.

Payments and Subscriptions

Payment for subscriptions, courses, or services must be made through approved channels. Prices are in Kenyan Shillings (KES) unless stated otherwise. Refunds are only provided according to law or explicitly stated service policies. FortyPharma does not store card details; payment processing is handled securely by our partners.

Termination and Suspension

FortyPharma may suspend or terminate accounts for violations of these Terms, suspected misuse, or technical reasons. Users may request account deletion by contacting support@fortypharma.co.ke. Termination does not relieve the user of outstanding payment obligations.

Disclaimers and Limitation of Liability

FortyPharma provides services “as is” and makes no warranties regarding accuracy, reliability, or availability. We are not liable for indirect, incidental, or consequential damages, including data loss or business interruptions. Users are responsible for backing up their materials and transactions.

Modifications to Terms

FortyPharma may update these Terms to reflect service changes, legal requirements, or operational improvements. The updated Terms are effective immediately upon posting. Continued use of the platform constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of Kenya. Any disputes arising from or relating to FortyPharma will be resolved exclusively by the courts of Kenya.
